NL – Ruby Decor v. Basic Holdings

Enforcement dispute following the earlier Ruby Decor decision (which may be read here).

Ruby c.s. seek an order prohibiting patentee Basic Holdings from executing the earlier obtained cross-border injunction against three new configurations of the contested product. The PI Judge states that Ruby c.s. is effectively seeking a declaration of non-infringement. In line with Basic Holdings’ defence, the Court dismisses the claims for lack of (urgent) interest, ordering Ruby c.s. to pay full legal costs.
