EU – Dutch Government issues statement on draft SEP proposal

The Dutch government has issued its statement on the current draft SEP proposal proposed by the Commission on 27 April 2023:

“The government acknowledges the importance of a well-functioning system of SEPs. The proposal is a far-reaching package to adapt the framework for SEPs and licensing under FRAND conditions. The government is not unwilling to improve the SEP system where useful and necessary, but at the same time underlines that as far as is known there are no major market distortions in the current system. For this reason, the government does not consider the proposal to be balanced. In addition, according to the government, the proposal is too limited in line with already well-functioning practical initiatives, such as patent pools.”
