EPLAW – webinar: ‘UPC first impressions and feedback collection’

Today, EPLAW hosted a webinar exclusive for its members titled ‘UPC: First Impressions and Feedback Collection’.

In the course of a one-hour session, participants delved into the initial encounters with the Unified Patent Court (UPC). The session commenced with an introduction by Myles Jelf (Bristows), followed by insights shared by others including Klaus Haft (HOYNG ROKH MONEGIER), Vilhelm Schröder (Hannes Snellman), Claeyé Kirian (Altius), and Tilman Müller-Stoy (Bardehle).

The discussions covered a range of topics, such as the obtaining of Preliminary Injunctions, the requirement to provide security and its practicalities, unexpected pitfalls in expediting UPC cases, the dress code for oral proceedings and ethical considerations when communicating directly with judges. An important point that was also discussed was the standard of assessment of validity and infringement in PI cases.

Though participants seemed to agree that the workflow based system was a hassle at times and also not always provided the correct information, the overall feedback on the initial experiences with the UPC was very positive. Judges were praised for their thorough preparation and detailed questioning, giving weak arguments no chance.
